1 - Use of Website

Our website is intended for customers who are 18 years or older. By using our website, you represent that you are at least 18 years old.

2 - Intellectual Property

All content on our website, including but not limited to text, images, and logos, is the property of The World of Emma and is protected by copyright laws. You may not use any content on our website without our express written consent.

3 - Product Information

We make every effort to ensure that the information on our website is accurate and up to date. However, we cannot guarantee the accuracy or completeness of the information provided. If you have any concerns about the accuracy of the information on our website, please contact us.

4 - Order Processing

We will process your order as soon as possible. However, please note that some items on our website are handmade and made to order, so processing times may vary. We will keep you informed of the status of your order throughout the process.

5 - Returns

We do not accept returns for change of mind on original artwork and custom orders.

To be eligible for a return on all other items, your item must be in the same condition that you received it, unworn/unused, with tags, and in its original packaging, along with the receipt/proof of purchase.

To request a return, you must contact us via email. If your return is accepted, you will be responsible for the return shipping charges. Items sent back to us without first requesting a return will not be accepted.

Please inspect your order upon reception. Contact us within 48 hours, if the item is defective, damaged or if you receive the wrong item.

We will notify you once we’ve received and inspected your return, and let you know if the refund is possible. If approved, you’ll be automatically refunded on your original payment method. It can take some time for the banks to process refunds.

For an exchange, the fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.

6 - Shipping and delivery

Domestic Shipping

We will make every effort to ship your order as soon as possible, but please note that some items on our website are handmade and made to order, so processing and shipping times may vary. We will keep you informed of the status of your order throughout the process. We ship our products to customers within Australia via our chosen shipping company. Delivery times may vary depending on your location, but we will provide you with a tracking number once your order has been shipped.

We cannot guarantee delivery time once your parcel has been dispatched. We are not responsible for any damage during shipping. All advertised delivery times are estimates only and not a guarantee.

International Shipping

We also offer international shipping to select countries. Delivery times may vary depending on your location and the shipping carrier. Import duties, taxes, and charges are not included in the item price or shipping cost. These charges are the buyer's responsibility. Please check with your country's customs office to determine what these additional costs will be prior to buying.

We are not responsible for any shipping deliveries that may be affected by customs, natural occurrences, transfers from our chosen shipping carrier to the local carrier in your country or air and ground transportation strikes or delays, nor any extra fee's, customs or back end charges once the package has exited Australia.

7 - Accuracy of Product Images and Disclaimer of Warranties

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected.

7 - Limitation of Liability

We will not be liable for any damages arising out of or in connection with the use of our website or the purchase of our products. This includes, but is not limited to, direct, indirect, special, incidental, or consequential damages.

8 - Changes to Terms of Service

We reserve the right to make changes to these Terms of Service at any time. Your continued use of our website following any changes to these terms will be deemed acceptance of those changes.

9 - Governing Law

These Terms of Service will be governed by and construed in accordance with the laws of Australia, without giving effect to any principles of conflicts of law.

10 - Custom Orders and Graphic Design Work

We offer custom artwork, graphic design and illustration services to our customers. If you are interested in a custom artwork or graphic design/illustration project, please contact us to discuss your project. Custom artwork and graphic design projects will be subject to a separate contract and terms of service (see below). A 50% deposit is required to start any custom artwork or graphic design/illustration project. The deposit is non-refundable if the client cancels the project for any reason. The remaining balance is due upon completion of the project.

Terms of Service for Custom Artwork and Graphic Design Services

Welcome to The World of Emma, a sole trader business based in Australia (“we” or “us”). By using our graphic design services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

Our graphic design services are intended for customers who are 18 years or older. By using our services, you represent that you are at least 18 years old.

2 - Intellectual Property

All designs created by us as a result of providing the services to you, will be owned by us and protected by copyright laws. You may not use any designs created by us without our express written consent. We retain the right to use the designs created for our clients as part of our portfolio and for self-promotion. It's the client's responsibility to make sure they have the rights to any images or content they provide to use in the designs, and they'll be held liable if any copyright infringement occurs.

3 - Service Description

We will provide the services as described in Exhibit A of this contract. We make every effort to ensure that the services are accurate and up to date. However, we cannot guarantee the accuracy or completeness of the services. If you have any concerns about the accuracy of the services, please contact us.

4 - Revisions

We will provide a specified number of revisions as described in Exhibit A of this contract. Any additional revisions will be subject to an additional fee of $100/hour as agreed upon by us and you.

5 - Deadlines

We will use reasonable endeavours to meet any performance dates specified, but any such dates shall be estimates only and time shall not be of the essence for performance of the services.

6 - Payment

You shall pay the fees as described in Exhibit A of this contract, upon receipt of an invoice from us. A 50% deposit is required to start any custom artwork and graphic design project. The deposit is non-refundable if you cancel the project for any reason. The remaining balance is due upon completion of the project.
